Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, mobile applications, and services provided by ColorLover Inc. ("ColorLover", "we", "us"). By using the Services you agree to these Terms. If you do not agree, do not use the Services.

1. Eligibility and accounts

You must be at least 13 years old, or the minimum age required in your jurisdiction, to use the Services. You are responsible for the accuracy of your account information and for all activity that occurs under your account. Keep your credentials confidential and notify us promptly of any unauthorized use.

2. The Services

ColorLover provides personal color analysis and related styling recommendations. Results are generated from the images and inputs you provide and are offered for personal styling purposes only. They are informational and subjective, and are not medical, dermatological, professional, or diagnostic advice of any kind. Outcomes vary with lighting, image quality, and individual characteristics, and we do not warrant any particular result.

3. Your content

You retain all rights in the images and other content you submit. You grant us a limited, non-exclusive, worldwide, royalty-free licence to host, store, process, and display that content solely to operate and provide the Services to you, and for no other purpose. You represent that you have the necessary rights to submit the content and that doing so does not violate any law or third-party right.

4. Acceptable use

You agree not to:

• Use the Services in violation of any applicable law or regulation
• Upload content depicting another person without their permission
• Reverse engineer, decompile, or attempt to extract source code, models, or datasets
• Interfere with, overload, or disrupt the Services or related infrastructure
• Access the Services by automated means except as expressly permitted by us
• Resell, sublicense, or commercially exploit the Services without our written consent

5. Purchases and subscriptions

Some features require a one-time purchase or a recurring subscription. Purchases made inside our mobile applications are processed by Apple or Google, and are subject to their terms and refund policies in addition to these Terms.

Subscriptions renew automatically at the then-current price until cancelled. You can cancel at any time through your app store account settings; cancellation takes effect at the end of the current billing period. Unless required by law or by the applicable app store policy, fees already paid are non-refundable.

6. Intellectual property

The Services, including all software, models, designs, text, graphics, and trademarks, are owned by ColorLover Inc. or its licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, personal, non-transferable, non-exclusive, revocable licence to use the Services. No other rights are granted.

7. Third-party services

The Services may link to or interoperate with third-party products and services. We do not control and are not responsible for third-party content, policies, or practices.

8. Disclaimers

To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that results will meet your expectations.

9. Limitation of liability

To the maximum extent permitted by law, ColorLover Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our aggregate liability arising out of or relating to the Services will not exceed the greater of the amount you paid us in the twelve months before the event giving rise to the claim, or fifty United States dollars (USD 50).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law.

10. Indemnity

You agree to indemnify and hold harmless ColorLover Inc. from any claims, damages, liabilities, and expenses arising out of your misuse of the Services, your content, or your violation of these Terms or applicable law.

11. Suspension and termination

You may stop using the Services at any time and may delete your account from within the app or by contacting us. We may suspend or terminate access if you materially breach these Terms, if required by law, or if continued provision would create risk or legal exposure for us or other users. Sections that by their nature should survive termination will survive.

12. Changes

We may modify these Terms from time to time. When we do, we will update the "Last updated" date and, for material changes, provide additional notice through the Services. Continued use after the changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law rules. Nothing in this section deprives a consumer of the protection of mandatory provisions of the law of their country of residence.
